Seller's Disclosure Statement
On June 13, 2001 House Bill 79 was signed into law as Act 224. The new amendment to the mandatory Seller's Disclosure Act (Chapter 508D, Hawaii Revised Statutes) became law upon signature by the Governor.
The law was amended to delete the requirement that the seller disclose all material facts that are disclosed by documents recorded in the Bureau of Conveyances of the state of Hawaii.
This means the seller is not required to examine public records in the Bureau of Conveyances when preparing the mandatory disclosure statement. How does this affect you, the Buyer, if you are working with the Seller's agent? Due to the Seller's agent's fiduciary responsibility to the Seller, the Seller's agent cannot help you investigate public records without the Seller's written permission. In other words, the Seller may not want their agent to uncover unknown facts and open a "can of worms" which the Seller was aware of.
